Today, I’ll be interviewing Chris Jurkiewicz from Venio.
What is “electronic discovery”? And how can companies prepare themselves in the event of a legal discovery request?
Electronic discovery (also called e-discovery or ediscovery) refers to any process in which electronic data is sought, located, secured, and searched with the intent of using it as evidence in a civil or criminal legal case. Companies can prepare themselves in the event of a legal discovery request by utilizing a variety of methods and technologies. There is no simple defense mechanism, but by following through on policies and procedures as well as utilizing the latest in legal hold, collection, and processing technologies.
What is the difference between computer forensics and simple electronic discovery? And why do companies need to be aware of this?
Computer forensics is a specialized form of e-discovery in which an investigation is carried out on the contents of the hard drive of a specific computer. After physically isolating the computer, investigators make a digital copy of the hard drive. Then the original computer is locked in a secure facility to maintain its pristine condition. All investigation is done on the digital copy.
While in the process of electronic discovery, data of all types can serve as evidence which can include text, images, calendar files, databases, etc. Companies need to be aware of this to ensure that the investigators’ best practices are being performed during the ediscovery/computer forensics process.
How does the use of databases, collaboration systems, email, flat files, etc… affect a company’s ediscovery strategy? What sort of data can be subject to an ediscovery request?
Anything stored electronically can be used during ediscovery which poses a challenge to attorneys who have to review all the discovered information in a timely manner. Due to the inexpensive cost of data storage available to an organization there has been an exponential growth of data within these organizations.
It has thus become easier for them to keep unnecessary data on their systems thereby increasing the overall cost of the litigation life cycle.
If a company has 5 years worth of files, stored across 500 disorganized tapes, how can you help them find critical information in a timely manner?
The best way to quickly and cost effectively handle this situation is to utilize tape indexing software supplied by one of Venio Systems’ technology partners, Index Engines. Their software scans tapes and then searches and extracts specific files and emails without the original backup software which allows the user to only work with relevant files thus saving time and money.
What items do most companies have on their “ediscovery wish list”?
The feedback we get from most companies is that they are looking to bring ediscovery process analysis software in-house to handle the overload of ESI they experience. An integral part of managing the ESI overload is to have fast and easily used early case assessment/first pass review software. These technologies allow experts to defensibly process and review ESI in a timely and cost effective manner.
What are some of the most common data handling mistakes that companies make, which can put them out of compliance?
Spoliation of data can occur in many phases of the Electronic Discovery Reference Model (EDRM) life cycle. Some mistakes can be as simple as copying files without using a write protection device or as complex as preparing proprietary data formats for review, but by utilizing trained ediscovery teams these mistakes can be avoided.
